This page explains how you may use the ThinkCodec website, what this site is and is not, and how an actual consulting engagement gets formed. It is not the agreement that governs any project.

1. Acceptance of these terms
By visiting or using this website (the site), you agree to these Terms of Service. If you do not agree, please do not use the site. These terms apply to everyone who visits thinkcodec.com, whether or not you ever become a ThinkCodec client.
2. This website is informational only
This site describes ThinkCodec LLC and its consulting services in general terms. It is provided for information only. Nothing on it is a proposal, a bid, a contract, or an offer to perform work, and using the site does not obligate ThinkCodec to provide any service to you.
3. NO ENGAGEMENT
Browsing this site, emailing [email protected], or having an initial call with us does not create a consulting engagement or any other professional relationship between you and ThinkCodec. An engagement exists only once both parties sign a separate written agreement. That agreement, not this website, governs the scope of work, fees, confidentiality, deliverables, and every other term of the engagement.
Until a signed agreement is in place, anything you share with us or that we share with you is for discussion purposes only, and neither side has committed to anything.
4. NO GUARANTEE OF OUTCOME
No consultancy can guarantee the result of a CMMC assessment, an audit, a certification, a score, or a government contract award, and ThinkCodec does not guarantee any of these outcomes. Compliance and accessibility work involves judgment calls, standards that keep changing, and decisions made by assessors, auditors, and agencies outside our control. What happened for another client is not a promise of what will happen for you.
5. Independence from assessment and certification bodies
ThinkCodec is independent of any C3PAO (Certified Third-Party Assessment Organization) and of any other assessment, certification, or accrediting body. We provide readiness and advisory consulting. We do not perform official CMMC certification assessments, and our consulting does not substitute for a required independent assessment by an authorized body. Where a law, contract, or program requires that independent assessment, arranging it stays your responsibility.
6. NOT LEGAL ADVICE
Content on this site about CMMC, NIST 800-171, Section 508, the ADA, or any other law, regulation, or standard is general information, not legal advice. It is not tailored to your organization and should not be relied on as a substitute for advice from a qualified attorney. You are responsible for understanding your own legal obligations.
7. Pricing shown on this site
Any pricing, fee ranges, or figures shown on this site are a starting point for discussion, not a quote and not a binding offer. If you engage us, the actual fees for your project will be set out in the separate signed agreement described in section 3.
8. Accuracy of content and changing standards
We try to keep this site accurate and current. Standards such as CMMC, NIST 800-171, and Section 508 change over time, and this site may not always reflect the most recent version of a standard, rule, or requirement. We do not warrant that any content here is complete, current, or error free, and you should confirm anything important against the current official source.
9. Intellectual property
The text, graphics, layout, and other content on this site belong to ThinkCodec LLC or are used with permission. You may view and print pages from this site for your own reference. You may not copy, republish, distribute, or otherwise use our content for commercial purposes without our prior written permission.
10. Acceptable use
When you use this site, please do not do any of the following:
- Scrape, crawl, or harvest content from this site using automated tools.
- Probe, scan, or test the security of this site or its infrastructure without our prior written authorization.
- Attempt to gain unauthorized access to any part of this site, or to any account, system, or network connected to it.
- Interfere with the normal operation of the site or any other visitor's use of it.
If you want to run authorized security testing against this site, contact us first at [email protected] and get written permission before you begin. As a security consultancy, we take that requirement seriously in both directions: testing carried out without our written permission is not authorized, and we handle any authorization request we grant the same way.
11. Third party links
This site may link to third party websites for convenience or reference. We do not control those sites and are not responsible for their content, accuracy, or practices. Linking to a third party site is not an endorsement of it.
12. DISCLAIMER OF WARRANTIES
This site and its content are provided as is and as available, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error free.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, ThinkCodec LLC will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of this site, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to your use of this site is limited to the greatest extent allowed by applicable law.
14. Indemnification
You agree to indemnify and hold harmless ThinkCodec LLC, its owners, and its personnel from any claim, loss, liability, or expense, including reasonable attorney's fees, arising from your misuse of this site or your violation of these terms.
15. Governing law and venue
These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute arising from these terms or your use of this site will be brought in the state courts of Texas, and you agree that those courts have exclusive jurisdiction and are the proper venue.
16. Severability
If a court finds any part of these terms unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest of these terms will remain in full effect.
17. Changes to these terms
We may revise these terms at any time. When we do, we will update the Last updated date at the top of this page. Continued use of the site after a revision means you accept the updated terms, so please check back from time to time.
